Q: I have bipolar depression and it has effected my life in some very negative ways...work as well...I have missed a considerable amount of work do to this condition...can I be let go for this?

5 years ago I was diagnosed with bipolar depression and have seen a therapist that whole time. Since then have gone through hell...I have a very difficult time dealing with people at any social level...I take meds for depression, moods and sleep...nothing works for very long...I have missed more than a considerable amount of work due to this condition...my concern is that the company I work for will try to get rid of me...I'm not a violent guy, never have been but they tried to pursue that as an avenue to letting me go...am I safe or can I be fired? It depends on how much time you have taken off.  When  going on short-term disability, notify HR right away.  Have your psychiatrist file FMLA paperwork ASAP - this protects your job.  If you are away for 90 days continuous, then the company can only guarantee a similar position, not necessarily the same position/pay.  Take the time you need in outpatient, but when outpatient becomes a crutch because you fear going back to work, it's probably time to go back to work.
