S.S.I. Disability denial due to lack of quarters paid in.

Hi, I just registered with this site, but chronic pain has been a major part of my life for 32 years.  I have had doctors from general practitioners to pain management specialists say that I'm too disabled to work yet I got denied for social security disability.  I was told that I haven't worked enough thus haven't paid enough quarters into the system to draw any out.  (I think they said I need 4 or 5 more quarters).  I'm working now after not having the need to for 13 years and my pain is excruciating.  My job in a jiffy store (one year) is too physical for me to keep up much longer.  I rely on a cane when not at work and I'm at the end of my rope.  I was told by two different lawyers that I need to apply for social security income instead of disability.  I neglected to state the factors for my pain so here they are in a nutshell...scoliosis ( approx.  47% curvature in lumbar, not sure how much in cervical ) diagnosed at the age of 13, no surgery.  Fibromyalgia, degenerative disc disease, both lumbar and cervical, COPD, chronic depression (go figure), disociative disorder, arthritis in back and both knees and bursitis in both hips.  I'm also almost 5 years out from breast cancer (double mastectomy) and pretty darned proud of that.  I'm 51 and am jealous when I see people 20 years my senior taking brisk morning walks or walking through Wal-mart unassisted.  Now the doctors are giving me meds to " keep me comfortable" until the need for a wheel chair is nessesary.  We used to get along all right on my husbands' income but with the economy in the state it's in, I have to supplement his income and I can't keep this up much longer.  I actually had a pain management specialist tell me that after reviewing my reports and MRI results that if it were him, he'd have put a bullet in his head long ago.  How encouraging is that?

So...if anyone out there has any ideas for me or suggestions on how to get my foot in the door with social security I'd surely appreciate it.  I know people who have never worked a day in their miserable lives and brag about drawing over a thousand dollars a month because they knew somebody who knew somebody and I'm legitamately needing some kind of help here.

Hi

I am so sorry for your pain.  congrats on the 5 years out with breast cancer.  What kind of denial are you talking about?  Did you have a hearing or just denied by clerk?

Please respond to this question as to many of us will have lots of suggestions once we know what the situation is.  I hope you have a relatively good day

I was denied through the US Postal in a letter.  Don't know what I've done with it now, it's been over 3 years.  Husband pushing me to go online and apply again now that I have a psychiatric diagnosis as well.  That's actually how I applied last time and had a cursory telephone interview.  (Online I mean, not the psychiatric aspect.)  I have been told however that psych. diagnosis will get you farther than dibilitating pain.  Sad state of affairs. 

Sorry it took so long to relpy, but I have a 13 y/o who monopolizes this contraption every waking minute...LOL.

Any advice will be taken quite seriously.

If you do not have enough work hours you apply for SSI instead of SSD. SSI is for people who have either never worked or for people who haven't worked enough hours. My ex brother-in-law just got SSI because he didn't have enough work hours. You said you have had several doctors tell you that you are disabled and can't work. You need to get a lawyer. The lawyer doesn't get paid unless you win. If you have doctors backing you up there is no reason for you to be turned down. As for the people who have bragged about getting $1000.00 a month after not ever working that is just not true. My ex brother-in-law gets between $600.00 and $700.00 a month. That is the most a person can get from SSI. If a married couple both qualify for SSI the most they can get is between $900.00 and $1000.00 a month. Of coarse people who qualify for SSD they go by how much money they have paid into FICA. I get SSD. I didn't use a lawyer and got it on my first try. Maybe you can get your SSI without a lawyer because of having those doctors backing you up. You definately deserve to get SSI so don't give up. Sometimes you have to try more than one time. I know of somebody that tried three times before they got it so don't give up. I've seen people get it who have way less problems than you do. I just got off the phone with S.S. and have appointments for myself and my foster son who is also diagnosed with bi-polar disorder.  From what I gathered from my conversation with them today S.S.I. is based on household income and my husband might make enough to make me ineligible.  S.S.D.  is of course based on quarters paid in.  For instance I would have had to work 5 of the 10 years during the time of the onset of my disability.  I was also told that it is not retroactive from the first time I was denied because I didn't appeal within the first 60 days.  Any insight into that?  I hate to quit my menial job, but I'm finding it harder and harder to drag my behind in there hurting like this on a daily basis.  I won't survive trying to get enough quarters under my belt to draw at this point.  The person I spoke with told me it doesn't matter how many doctors I have backing me if I don't have the quarters.   I feel like I'm beating a dead horse.
