Question
HELPME!

Can I lose my job due to a medical condition?

I have multiple kidney stones in my kidney and my ureter.  The pain is unbelievable but they are only 3 cm and do not do any procedures to break them up unless they are 4 cm or more.  I have been to the ER numerous times (PCP referred) and followed up with my PCP, which was pointless, they did nothing.  The ER said all they can do is manage the pain, which they did.  But the stones have not passed and the pain comes out of nowhere.  I have used almost all of my vacation and sick days, I have doctors excuses for every day I have missed and I gave my employer the ER paperwork.  I was just put on probation because I have only been at this job 6 months and the amount of time taken off due to my kidney stones is unacceptable...even though I have excuses and am clearly making every effort to come to work.  I was sent home last week because of an attack.  I am currently having another attack and am at work.  I called my doctor crying hysterically because I can't leave to go to the ER til 5 and I can't miss work because I will lose my job and I'm a single mom.  Is it legal for my employer to fire me due to a medical condition I have no control over?  What can I do to protect myself, I feel as if  I'm being discriminated against because of this medical condition that appeared out of nowhere! PS. I have changed my diet and only drink water and crystal light...no more soda, coffee, caffine or even sugary drinks.

I am not sure but, don't know for sure..I would check human resorce dept, Do you work for a large company or small company? I would think as long as you have proof you should be ok, your obvsiously not faking. I hope your stones pass and everything goes good from here on out. How long have you been dealing with the kidney stone's? I feel it is no different then if you were in a car accident,,not your fault so how can you be fired? I think maybe call Dept of Employee right's or something look in the front of yor phone book. Good luck.
