I was in a severe boating accident in 2004 that created a lot of damage. I've seen the same pain doctor since then. After years of various treatments that didn't work he decided I was a candidate for a Pain Pump. This is the problem I need opinions on. I had the pump installed in Oct 2011. In January I "stumbled" on the fact that the pump was FDA Class I recalled. When I tried to call and discuss this with my doctor he wouldn't take my calls.... in fact I was forced to change pain doctors because of this. Dr. #2 treated me VERY badly, in fact so badly that after 2.5 months my primary doctor agreed to move me to another doctor outside our plan, which is usually unheard of (that's how badly I was being treated). I found out from Dr. 3 - Who sits on the California Medical Board, that Dr. 1 and Dr. 2 were previous partners.... it all started making sense to me why I was being treated so badly. I can't get an attorney to represent me... the fact the manufacturer implanted a Recalled pump, because I haven't been injured.. YET. Dr. 3 told me I need to get the pump removed immediately.... What recourse do I have....The attorneys don't want to take on such a huge manufacturer because the monetary award would ultimately be so small.... (i.e. not much in it for them), because I haven't been injured "YET" from the pump...I just don't know what to do.
