Q: Anyone to contact if you have been declined social security disability and appealed

I have Fibromyalgia and have not worked for 7 years. Are there any politicians or judges or anyone I can write to in Delaware that can help me? After being declined for social security I have been diagnosed with other illness also and am getting more tests because of more pain and more problems after I was declined and appealed. Thank you. Some examples are, I was tested for Lyme disease before I was declined,  after I was declined it was positive once.  Also before I tested negative for Lupus and after I was declined I just got a positive result.

I take it you were declined and then appealed and then appeared before a Judge and then got declined again.  I have heard of people being successful after going to the local elected officials but I'm not sure how that works.

 

My understanding is that once the judge has declined your appeal you cannot reapply again using the same evidence. However if you have new medical evidence then you should be able to reapply for disability. if you didn't use a lawyer in your last case be sure to strongly consider using one in this one. 

 

Also make sure that your physician is on board and is competent at writing disability evaluations. You might want to check outthe Vermont CFIDS Association disability manual for tips. It's on chronic fatigue syndrome but it raises important issues for fibromyalgia patients as well. http://www.monkeyswithwings.com/vtcfids.html

Hi Daisymay,

 

You don't give enough detail about your denial. Was it denied through the SSA or in an administrative hearing?  if it was through the SSA itself, you want to appeal and keep appealing until the matter is found in your favor.  most denials are overturned on thier next go-round.

 

An administrative hearing kind of has the appearance of a court proceeding but is not quite there yet. Consequently, you may have an attorney present--but at this level you can still have any advocate you wish assist you with stating your case.  In  that case, I would recommend contacting your local Center for Independent Living or CIL.  This is an advocacy organization that is run by and for people with disabilities and they can assist you in obtaining your SSDI or help you to fight to get it.  The CILs will do this free of charge to you and will never charge you a fee to act as an advocate on your behalf.  There are over 300 CILs country wide and you probably have one pretty close to where you live. they also often know attorneys that specialize in SSA matters and often will do the case for free.
