My former family doctor hates, because my Mother hates, no telling what Mother has said to convince my doctor to treate me so badly. None the less, there is clearly nothing I can do or say to change this doctor's mind. She was insulted when I asked for all notes, tests, ect., everything she has on file in reference to me. I about fell over, she makes it so blantantly obvious of her hate! I am in total disbelieve! The errors she made were unbelievable in reference to my office visits. How dare I question her! Now I am convinced whe has distorted my personal medical records. What can I do? How can I recover from this horror?

Dear Baffalled and Buffudeled -

 

You not only have a right to everything in your medical records, you have a right to correcttions of any errors you find, and a right to add information or note your disagreement in the records. Teri Robert wrote an article on your Rights to your Medical Records under HIPAA that you should read. If the doctor objects you can politely remind her that the HIPAA law gives you a right to those records.

 

The doctor's office has to give you a copy of everything within 30 days of your request, and if you file an objection to something in the record and ask them to change it or include a note of your disagreement, they can take 60 - 90 days to make the changes.

 

When you find a new doctor, you can meet them and establish your relationship first, and explain about any problem with the records before sending them. That way their first impression does not have to come from what the other doctor said.
