Q: i am not sure if this is a legal or depressed question.

I am not sure if this is a legal or depressed question.  My sister stabbed her husband who passed away.

She went into depression and was admitted to Hospital for "severe depression". the husbands family indicated they want to put the whole thing behind them. However, she is being charged for "murder" and now claims self defence and is getting witness to say he was violent.

I personally have not known him to be violent even when drunk. Can a depressed person think rationally? Are they capable of covering up their actions and in the process cause more hurt? This has happened 6 months ago.  After a month she was released from hosipal she continued a daily normal life. spoke and acted like a normal person. Then suddenly, when she needs to face the social worker or her attorney, she is severly depressed and "highly sedated". I am confused and in doubt.

This is a very complex question indeed and one for which I do not have an answer.  The court system will have to prove or disprove her mental state upon committing the act of violence against her husband. 

 

I am very sorry that this has happened to your family.  How are you holding up through all of this?

I have questions about your questions. I wonder how close you two are or were.

 

- It is only after she stabbed her husband that she "went into depression"? Do people who engaged with her regularly believe she had depressive symptoms? Had she told anyone or could anyone have suspected that the marriage was abusive one way or the other. Was it known to be a happy marriage before the death?

 

- It is interesting that the deceased's side of the family does not want to have charges of murder pursued.

 

- Do the prosecutors believe your sister is dissembling? Do you? Do you think prosecutors are  going through the motions to pursue the case for appearance purposes? This would depend a lot on the size of the community and the resources available. Is there a charge of premeditation? Stabbing, especially if done by an average female against an average male, is an easy way to injure, but not kill. Where was he stabbed? If his throat were cleanly slit, I'd have a big problem with your sister's story.

 

- My thought is that the woman is in deep distress over the incident, murder, accident, self-defense, or whatever the truth is. It is highly likely that she is on strong medication. The thought of meeting with attorneys and others "on the record" can put fear in the innocent and cause them to misspeak.

 

- Does your sister have a good lawyer?

You have alot of questions, to which i have no answers to... However, I will tell you that the judge found her innocent on the following reasons:

1 - it was one single stab wound (not multiple)

2 - There were no witnesses present at the time of the stabbing

3 - There was history of abuse according to 1 (unqualified) witness that works in the community (who is a family member) despite there being no proof (medical or police record)

 

She is happy and healthy and in a new relationship. 

Now for some honesty.  She is not my sister.  But if you are still interested, I have autopsy report, Affidavits and the recording of the court proceding.  You can draw your own conclusion of the situation.
