Brooklyn,

It is all about the risk a person is willing to take. A majority of people in the United States ARE infected with HSV-1 on some part of their body. Your partner can still perform oral sex on you, but you should avoid this during times that you are having a breakout. With genital HSV-1, you should have less breakouts and overall less viral shedding in comparison to genital HSV-2. Since you haven't had a cold sore, you probably aren't infected in the nerves of your mouth, so you can perform oral sex with relative safety. However, the virus can spread, so if you ever get a cold sore you know that you are now infected in your mouth.

Conclusion: He can still get it

There are two types of HSV, HSV type 1 and 2, and both can cause genital herpes.
