Can you contract genital herpes by masturbating your partner, who has genital herpes, (while no outbreak) and then touching yourself a few minutes later? Or is it more likely to be transmitted if you touch them and then your genitals immediately afterward?

Probably the latter but HSV1 and 2 are highly infectious when there are active lesions so you need to be cautious in general ad make sure that you do not expose your genital mucosal tissue to active herpes lesions or virus.
