Oral herpes (herpes labialis) is most often caused by herpes simplex virus 1 (HSV-1) but can also be caused by herpes simplex virus 2 (HSV-2). So the answer is yes, you can get it from someone who has it in their mouth. I can not say how common it is, but it's a well known way of herpes transmission.
