Lost my appeal to my application denial on SSDI.  Furious

 

They acknowledged my disabilities but still feel that an employer can accommodate my migraine issues and fibromyalgia issues and I can can continue to work as a computer operator.  Wacko

 

Well, I sure wish they would tell that to folks that I've applied for the 67 jobs to.  I have had NO call backs  Chatty 2  from any of them.  I've changed my resumes and had an expert look over my resumes and have made an honest attempt to find a job.  I've even looked at lower paying jobs and jobs out of state.

 

Workman's comp has paid for the damage to my knee  Crutches  so now I have wear a band around my knee to keep the patella from the femur or it pinches.  I'm also doing physical therapy as well for it.  So add another 1/2 a day in physical therapy.  What employer is going to allow my coming to work at 10 in the morning every day? 

 

My hubby has been TOTALLY denied by SSDI so we are taking his out of state to try again and seeing if he has better success somewhere else with more compassionate people.  He will be in the same state his family doctor is in.

 

I've submitted my records to a lawyer and hope he'll take my case.  Cause if he does take it, then I'm confident I'll win.  He only takes cases when he feels confident he can win it.  He's a really nice guy.  He also does workmans comp and may help with my newest malady Embarassed   .... carpal tunnel syndrome. 

 

My orthopedic surgeon wants to do the work (I love him Heart *G*) but we are waiting for approval from workmans comp to accept the injury as job related.  I guess working on computers for 20 years doesn't count.

 

I've run out of unemployment money.  Even though the pamphlet they give you says it lasts 52 weeks, don't believe it.  Mine lasted 6 months.  BUT Micron gets an extension because their jobs went overseas!!!  Now why can't I get an extension since I'm basically in the same field?  Just gives me more to compete with.  Just doesn't make sense.

 

Soooo... now that the cold weather is upon us, headaches are as well.  Found the greatest little sun glare fighter for my car.  The visor extends out to the side and there is a sun shield the extends down to reduce the glare.  I got it a Dr. Leonards and it works great!!!  That should help cut down my migraines quite a bit.

 

I guess my next step is to get a job.  I'll have to go down to unemployment and see what they can find for me.  Meanwhile, come December, we will be without insurance for the first time in 20+ years.

 

But I have plans for that as well *G*

  I know,it's horrible.My sister has MS & Parkinson's,Nov. 26th will be her 3rd time.I think she'll get it this time.But even then,it'll take her 8months to get the money.

  I talked to my aunt in Pennsylvania.My cousin lived at home all these yrs.He's an alcoholic,never held a steady job.Was at a job almost long enough to get insurance,when he got drunk & fell down the stairs.

  He had major injuries.He damaged his neck,almost broke it.He was in a coma.While he was in a coma,a social worker came up to the room,my aunt filled out the form.He immediately was given a card that was for disability.It was done.He moved out.Now gets disability,and has his own place.(which helps my aunt greatly).

  It's too bad Pa. is so far away.I'll tell you,I'd like to go back and take my sister with me,maybe we'll stay with my aunt!Big Smile

Social Security rubber stamps paperwork that really deserves SSDI and passes SSDI to those who don't deserve it. I'm receiving Disability under FERS and I was medically disqualified from the Air Force Reserves. Later I used a SS attorney and my disability was approve the first time for a Generalized Anxiety Disorder, Depression and Panic Attacks. Of course I've got, no lie, 3 feet of medical documentation

How frustrating that must be! 

 

Due to numerous health issues and my continued need for "unscheduled leave" I made a request for medical accommodation, AND WAS DENIED!  Now, they are trying to use my request against me to say that  I am NOT QUALIFIED to do my job.  Joyous... isn't it!

 

My Doc has suggested that I seek legal counsel because I am entitled to an accommodation, so my employer is in violation of the Rehabilation Act of 1973.  Now you can laugh, I'm employed with the FEDERAL GOVERNMENT...who MADE THE RULES regarding accommodation....yet they do not play by the rules! 

 

Please let me know how it goes with the lawyer... I may be seeking one myself, because if they continue to give me grief, I will have no recourse other than take legal action.  BEST LUCK in your pursuits.  (BTW I have also applied out of state for a lower paying job... we'll see if that helps)

Hi There!

 

The lawyer I found says that he needs doctors letters before he'll take my case.  So I'm trying to get my doctors to write letters that I can't work or would have difficulty.  My rheumy will NOT write the letter.  He expects SSDI to ask him to write it.  The lawyer has had experience with him and says he has had to struggle with him to even write a decent letter to make sense. 

 

So I emailed the lawyer yesterday asking what rheumy he has had good luck with.  I'm looking for a "second" opinion *G*. 

 

I sent letters to my pain doctor and my neurologist.  Haven't heard back from them yet.  I've been down with a bad head cold for the past week so couldn't call them because I get laryngitis with these colds.

 

Hopefully, Monday I'll be able to call and find out what they plan to do.

 

My hubby has reapplied but in another state.  It looks like him might have better luck there.  Hope so... the judge he had here was mean and nasty.  And his advocate was an idiot.  I know better now to get a real lawyer vs an advocate.

 

My unemployment finally ran out so I have no money coming in.  We'll probably be canceling insurance next.  Hubby went down and checked out the food bank and brought home some cans of things.

 

But he's a pessimist and I'm an optimist.  Things will look up!!!!  I guarantee it !!!!!  Grin

Hi Lyn!

 

Well, I called workmans comp insurance and talked to the rep and she has approved my carpal tunnel surgery.  So at least that will happen. 

 

But I need to get a lawyer.  I gave up on the one I wanted.  There is another group of lawyers that do SSDI and a friend from where I do aqua therapy had great luck with one of their lawyers.  So I'm going to contact them and see how they are without having a magical "can't work" letter from a doctor.

 

Meanwhile, it seems lately, I'm really getting confused!!!  I'm getting so rattled about the insurance coming to the end that I had scheduled an out of state appt with a doc in between two other appts.  Sigh..

 

I gotta call and see if I can get the second moved out to Friday the 30th.  My mind is slllooowwwlly going.

 

Still chugging away!!!

I feel for anyone who is unhealthy and not wealthy.  I am a 38 year old female on SSDI due to oh so many things.  I've had chronic migraines for over 10 years now.  I had my first migraine when I was 9.  I've seen so many doctors and run the gammet of medications, none of which seem to help me enough to be able to work.  The site effects of most medications I cannot handle.  After so many years dealing with chronic pain I developed depression and anxiety.  I had been using FMLA incrementally at my last job, but they made my life hell by not accommodating my disabilities.  Wonder if anyone here knows that you can use FMLA for illnesses incrementally, as needed.  If you don't...I'm here to tell you that you CAN.  If you get a migraine and have to leave work a few hours early, you can but be sure to keep track of your hours used.  It is unpaid leave, but excused.  I've seen tons of doctors of various specialties.  None have helped me, and I feel that some have actually made things worse.  Research also shows that ppl dealing with daily chronic pain do sustain some brain damage to a degree, and depression develops for obvious reasons.  I wish you the best in your search for better health and living.  The only advice I have, and it won't sound all that great, is to get ALL medical records to your lawyer.  Any health problem you've ever had or have, regardless of the degree, that may interfere with your ability to work.  I have TMJ, another cause for migraines, and I listed it on my SSDI application.  Get your doctors' support.  I've seen migraine specialists, psychiatrists, neurologists, and injury specialists.  Get as much documentation as possible.  The best thing is a letter of disability from your doctor.  I have one from my neurologist even though she advised me that she's never known anyone to get SSDI due to migraines.  Also, if you take the medical exam for the state doctor, unfortunately their guidelines suck.  One must fail or do poorly in ALL areas.  Those questions of how long can you sit, stand, walk, bend, etc.  If someone can do some things and not others, they will think you have some ability.   Take that comment and think about it.  ;o)

I've been on SSDI since 2004, and I would have to say things are much worse now.  There's never enough money.  Not to mention, once you get SSDI you have to wait 2 years to get medicare.  I guess that's some governmental population control...they just want us to die before we can collect any money to be able to just live.  I've babbled on enough.  I hope I have said some things that may be helpful to you or others who might read this.  Hang in there and be strong.  If you need a little positive motivation watch The Secret or read the book.  Right now I'm looking into grants for home remodeling.  You will have to find ways to save money and stash cash because you cannot have more then $2000 in anything.  I have emergency money I got from refinancing.  If my A/C broke or something, I wouldn't have any way to fix it if I didn't do that.
