Migraine a disability?

It really is an exciting time if you suffer from migraines!

 

In September 2008, the ADA Amendments Act, which has been passed by both houses of Congress is expected to be signed into law by President George W. Bush. The Act expands the interpretation of the Americans with Disabilities Act of 1990 (ADA), which covers all private employers, state and local governments, and educational institutions that employ 15 or more individuals. This statute prohibits discrimination against people with disabilities who are qualified for the job.

 

So what does that mean for migraine sufferers?

 

Under the old ADA court interpretations, migraines didn't make the cut as a disabling condition, well, hopefully the time of your work not having to accommodate you because you aren't "disabled enough" is over.

 

Just because most of us do not suffer from a crippling migraine attack 24/7 does not mean that we do not work very hard to mitigate the effects of our disease with trigger management, lifestyle changes, preventative and rescue medications, yet people who don't experience migraines themselves don't see this because we suffer from an invisible illness..."but you look so good!" Right!

 

This law will level the playing field for migrianeurs, giving them a chance to remain independent, productive and competitive in the job market.

 

Personally I have been juggling working nights, FMLA, state disability leave, and an employer who is NOT migraine friendly. The ADA Amendments Act will go a long way to finally getting the leverage that I need in order to get reassigned to a shift that better suits my health.

I am a social worker in a nursing home and do not feel total support from my employer.  They have allowed me to use FMLA.  My mirgraines have are caused by scents.  I have asked for a no scent policy for staff only.  My employer will not do that instead they have me report to the human resorce person that a staff person is wearing a scent, then she will go and talk to them and ask them not to wear a scent.  Well, that is a battle that I am not winning.  In fact since I have been at the nursing home my headaces have gotten worse.  I filed a complaint with the depeartement of labor who investagted and found that my employer has done eveything that they can.  So I am trapped.  I am looking for another job, no luck yet. I am sick almost every day.  I almost have no life and I am in pain.  If my employer would be more supportive then I might have a chance to feel better.

Well, just to share my story.  I have migraines on a daily basis. Sometimes, and that's some days, I can abort it, or can help it with meds. But, I'm home now. I haven't worked in 1 year and 4 months. I had a great job, and I just couldn't do it anymore, with lying my head down, and looking like a ghost everyday. Unfortunately, I had tried even working part-time, and couldn't continue. I was getting wrote up by the "new" boss, and I was trying to keep up on my work. Truth is, she didn't take much a way from my duties when I went part-time. I was denied 2x, due to my age, (42) now. Also, Social Security told me, that because of my "work history," and age, and education, I could continue doing the same work. Ha! Well, if that was the case, I'd still be making good money, and working. However, I am seeing someone for depression now, which may help my case. But,........I find it BS that it is not considered a disability. It is. It's taken a toll on my life, and I'm trying to have a life the best I can. Without my family, and my friends, or my faith in God, I wouldn't want to live. That sounds terrible I know, but it's the truth. I don't do much living with migrianes everyday. So, someone needs to find us a cure, or at least give us the benefits we deserve. I shouldn't be punished for having a good work record and education. Well, I know you can't help none of this, but I wanted to share my story.

i totally agree, i ahev been suffering with migraines since childhood, and the older i get the worser they get, they are starting to take over my life. I plan things around migraines! And yes, employers do not understand at all what we go through. I'm still working at this present time, but i keep getting in trouble for sick time leave, so i don't know how long that is going to last, yes we do need help.

Hope you get some releif. I do take Midrin, and sometimes it helps me. Sometimes, nothing helps. I hated having to quit my job, and I could never go back up to what I was making. Besides that, I'm still getting migraines, daily, and can't be accountable to work all the time.

I sure hope we get some help. I'm still waiting on a court date. I'm 42, and my attorney said that is young, and doesn't help my case. They really "don't get it", they don't beleive that migraines is a real dibiltating disease.
