Q: What protections exist for American secondary students who suffer with migraines?

Both our high school-aged children (one boy, one girl) have been diagnosed as suffering migraines and both have missed enough hours of school due to migraines they will receive incompletes this year and have to participate in 'credit remediation' next year. This adds stress .... which triggers migraines ... I know how our employers must address workers with ADA protected conditions but haven't found anything clearly written on these same issues for students in the public school system. Does this qualify for a 504 plan? I have no idea. Help?

Dear Kate -

 

The ADA Amendments Act which went into affect January of this year makes very clear that episodic illnesses such as Migraine are covered disabilities, and 504 plans are available to all children with disabilities which might interfere with their ability to get an education. Check the Protecting Students with Disabilities FAQ on the Department of Education web site for more information.  Your school district should come up with a plan to help your children.
