While the Orange Book tells the patent expiration dates of brand name drugs, it doesn't really tell when the drug is "going generic." For example, the patent on injectable Imitrex has already expired, months ago, but there is no generic avialable yet.

 

Companies that wish to produce generics once a brand name patent has expired can apply for tentative FDA approval a couple of years before the patent expires. But, that doesn't mean that the generics will be available immediately upon the expiration of the patent.

 

Hope this makes things a bit clearer.
