if someone that has MS developes seizures would they qualify for disability?
my neice has MS and now she's developed seizures too. she works full time in a group home but now with the seizures the administrator is changing her schedule so she doesn't work alone due to the risk of seizuring. my question is, would she be qualified for disability and if so, she wants to continue to work but maybe if she worked part time it would be better for her health. could she work part time and still collect disability? she's has several accidents because of falls.
Hi Autumnsun,
Welcome. I'm sorry to hear that your niece has developed seizures with her MS. Has she been tested for epilepsy? There are very specific criteria in determining Social Security Disability eligibility including the frequency, severity, and type of seizures.
Here is an overview of Society Security Programs.
Here is the big "Blue Book" Guide - Disability Evaluation under Social Security which includes discusses Neurological Disorders in Section 11 (beginning on page 48).
The National MS Society has an excellent guide to Social Security, MS, and Disability but their site is down at this very moment and I can't pull it up.
Regarding part-time work while collecting disability, here is the "Red Book" - Guide to Employment Supports for Individuals with Disabilities under SSDI and SSI Programs.
In general, it is my understanding that individuals on SSDI can work part-time, earning up to $940 (rate in 2008) without risking the loss of SSDI payments. It often takes a long time to apply and be approved for disability.
I'd be more concerned with discussing MS progression with the neurologist, specifically mentioning the seizure-like activity. it's possible that she's experiencing an exacerbation and maybe needs a round of steroids or other medical intervention. Call the doctor.
Thanks for you question. I hope others will also contribute their thoughts.
Lisa
