Hey Tommy

Yeah...this doesn't sit right with me either.  If you did not quit voluntarily and they told you to resign after you asked for a leave of absence...I would think your employer is in the wrong.  But your best bet is to call your local unemployment office for the answer to your question.

I also have some links and numbers you can pursue:

1.  Take a look at the Americans with Disabilities home page.  Someone there can tell you what your rights are.

2. The next is the number for the National MS Society.  You can call 1-800-344-4867 to get information from your local chapter.

3. Also here is a number for an organization called MS Friends.  You can receive peer support on the phone toll free.  Their number is 1-866-673-7436  and you can call any time of day or night any time during the week.

I hope you get some resolution to your problem.  In a perfect world these things would not happen.  Sorry you are going through this.

Let us know how things work out for you.

Yes you need legal advise on this. If they pressured you into resigning this would be against all the EEOC/ADA laws out there. I hope you documentated everything, names, dates, writtem communications,... Your lawyer will want to know this also. Under ADA they cannot get away by just rejecting your request, expically if it is medical related. In my state, under ADA you have 90 days to be off. Here they will not cover your benefits, but you can also ellect to pay them in as a member of the group coverage. Bring pressure to bear on them. I hope in your resignation letter you put down the reasons for you request on giving them notice.......God Bless..Hope All Works out..John

P.S.

Also as the other post stated apply for unemployeement and put down the reasons that you had been forced to resign, over a serious health issue, which the employeer didn't address...if denied, appeal it.
